Right to vote - The government opposes changes in Councils’ Statutes

The Council of Genoa – decree 205 issued July 27th 2004 – approved of a new statute that allows migrant citizens’ right to vote to district and council elections. Only regularly staying migrants are allowed to vote.
The government opposes this provision and obtained its annulment – the President of Republic issued a decree past August 17th 2005 (following a Council of State’s opinion issued past July 6th).

There’s something strange about this: past year Council of State approved of the fact that Councils’ Statutes could be changed in the sense of at least allowing migrants to vote to district’s elections, today a new opinion denies the quoted right.
The Council of Genoa appealed against the government’s annulment. In the meanwhile other councils are trying to allow migrants to vote. The Council of Padua is getting ready to change its own Statute, we still do not know whether the change will concern council and district elections or just districts. This debate is very important since it will surely again reach Parliament.
Government states that Constitutional changes are necessary to introduce the right to vote to migrant citizens, whereas no Constitutional change was necessary when EU citizens living in Italy were allowed to vote. We shouldn’t forget that Italian Constitution does not make any difference between EU and non-EU citizens since it was issued back in 1948 when EU did not exist.
