Planned massacres: how measures against clandestine migrations become death instruments

by Fulvio Vassallo Paleologo, Università di Palermo

The massacre that took place September 10th night in front of Sicilian shores near Gela, the drowning of dozens of migrant citizens coming from Horn of Africa again show the failure of the policies that try to contrast illegal immigrations. These citizens were all potential asylum seekers and they had to try to reach Europe through boat people. Actual laws violate human rights. There are thousands of migrants that die in the attempt of reaching Europe: they are the victims of the system that controls “migration flows”. Migrants massacres are used as “deterrent” to the desperate that run away from the poorest regions of the world as well as saying that stricter rules are to stop immigration should calm European citizens down. And everything comes against men, women, children that escape from wars and conflicts that rich countries do exploit to cheaply buy resources that are fundamental to their own economies.

“Clandestine” massacres are not the effect of misfortune but they are a consequence of European governments’ politics: lawfully entering Europe is almost impossible! EU and national laws are everyday more strict and they only worry about that terrorists may try to come to Europe disguised as asylum seekers. EU Court on human rights is ignored by governments…
What’s really worrying is that suspicion there is against asylum seekers: they are rejected, deported to other countries, administrative detention becomes longer and longer. Courts and judges controls on detention and identification centres are very rare and repatriations and deportations secretly occur: no one can possibly know where the flights that take off from Lampedusa, Catania, Crotone will eventually land; as if hiding unlawful facts would avoid protests.
When asylum are denied the right to stay they can be expelled without any chance to appeal against denials. In this Italy has anticipated the worst EU directives on asylum and refugee status recognition.
The constant violation of migrants rights (and above all of asylum seekers’) is often a consequence of laws that are too generically written and that leave interpretations on citizens effective status to police. This means that real juridical controls are almost missing. Administrative detention centres are defined “centri di accoglienza” (welcome centres), potential asylum seekers are called clandestine even if they come from countries such as Somalia, Eritrea from which people flee away in search of international protection. Italian police headquarters do not inform on asylum applications whereas they immediately order expulsions, which are referred of so late that citizens cannot appeal against the provision. Too many asylum seekers are treated and considered clandestine though their origins are often very clear and evident and this happens also in case of wrecks at sea.
This mystification in words and definition of individuals corresponds to a precise policy made up of concealment of facts and of exploitation of social selfishness. This policy is based upon the control of media and it produces terrible effects on citizens’ common sense. Media talk about false instrumental asylum applications but the truth is that inside detention centres there are no interpreters and identification are improper. And this often happens thanks to would-be cultural mediators. Real identifications, the ones all authoritarian countries do know well, happen in the countries in between, the ones migrants pass through when forcedly repatriated. Repatriations occur of course in violation of all international conventions.
Italy and Europe share the same politics and they externalize torture and they do not care of the inhuman demoting treatments potential asylum seekers do suffer when rejected from Europe. European governments seem not to care about eventual reports pursued by EU Court or by EU Parliament.
Few days ago EU Parliament again postponed the enforcement of the directive that should even all procedures concerning asylum and asylum seekers... And Italy is the sole EU country that does have any law on asylum.
