Some days ago in Friuli Venezia Giulia a very important institutional meeting took place, its aim was discussing from an administrative point of view how to present appeal against the detention centre to TAR courts in Lazio and in Veneto and to Constitutional Court as well.
The region, the district and the council of Gradisca are involved in the appeal. In addition to this institutional path, a demonstration is being prepared. The demonstration is to take place next October 22nd and it will be in Gradisca and also in Bari S.Paolo, the other place where a new detention centre is to be soon opened.
Some updates in the following interview with Alessandro Metz, regional councillor in Friuli Venezia Giulia.
Question - Can you refer us of the administrative novelties concerning Gradisca’s removal centre?
Answer - Next October 22nd there are to be tow demonstrations: one in Gradisca and one in Bari. It is in fact very important that the campaign against detention centres keeps being active in order to avoid the opening of such structures.
From an administrative and legal point of view there are of course some novelties. Regional institutions palace has recently hosted a meeting among lawyers, the Council of Gradisca d’Isonzo, Gorizia’s district and university professors. The meeting aimed to evaluate tha chance to appeal to court against the opening of the centre. Appeal would be signed by local institutions.
Legal advisors referred that appeal to Lazio’s TAR court is actually possible “thanks” to government’s administrative hyperinflation. In fact the government is not respecting Council of Ministries’ decrees that concern the procedures that must be followed in the opening of detention centres. Therefore appeal to court can be possible since Friuli Venezia Giulia has never been asked to intervene in anything that has to do with this removal centre.
TAR court in Lazio though is very long and this is why appeal to TAR court in Friuli Venezia Giulia can be presented as well. Appeal is to ask for the suspension of the works up the day TAR in Lazio sentences.
Another interesting aspect concerns the fact that our region can also refer to Constitutional Court to impugn the region’s lese-majesty in the lack of emergencies.
According to professors there have not been emergencies that imply the immediate opening of detention centre for years. Actual laws say this and they evidently contrast the existence of removal centres and we believe that applying to Constitutional Court would be important nationwide and not only to Gradisca.
Question - What is to soon happen then?
Answer - Actual passages can overcome the institutional “shyness” we’ve so far met, institutions thought that proofs were necessary to appeal against the centre. Next November 15th appeal can be presented and we are pushing that institutions do appeal. From a political point of view, this is extremely important because actual immigration management politics are very repressive and strict and nothing has so far been done in this legal-administrative way.
