Flow Decree 2008 – 150,000 available quota

Colf, caretakers and special nationalities have the priority. Foreign employers holding the residence permit not later than the 10th of December.

On the 3rd of December 2008 the law concerning the Flow Decree 2008 has been signed. It has been published on the Official Journal n.288 of the 10th of December 2008.
On the 5th of December an information leaflet has been advanced.

Division of the quota
150,000 entries divided between:
44,600 domestic workers or workers belonging to different productive sectors, coming from countries which have already signed or are supposed to sign specific cooperation agreements involving migration issues.

There is no applications forwarding

There is not going to be any click day . Only the applications (in the submission list) submitted not later than the 31st of May 2008 within the framework of the Flow Decree 2007 will be considered.

The foreign employers holding only the residence permit
The Ministry of the Interior site is going to open a specific webpage from the 15th of December until the 3rd of January where the foreign employers should confirm their interest in assuming a foreign employee.
The applications submitted by the foreign employers are going to be considered only if:
They hold a long-term EC permit of stay;
They have forwarded the application to obtain it not later than the 10th of December 2008;
They hold the old residence permit;
They hold the residence permit for relatives of European Community-citizens released by means of the D.Lgs n. 30/2007.

No confirmation is requested for the Italian employers.

The confirmation procedure involving foreign employers
The procedure should be carried out through a specific link.
There is no need to install any program, neither to execute any authentication.
It is only necessary to fill in the two forms.
The first one regards the 12 characters of the identification code written on the application forwarding receipt of 2007 and the corresponding 32 characters of the code check written on the old application forwarding receipt (you can look for the code on the following site www.nullaostalavoro.interno.it ).
In the second form you should fill in the main points of the residence permit.

The applications regarding the Flow Decree 2008 will be considered only when all the 2007 applications are considered. The list containing the offices – Sportelli Unici- which will have finished the paperwork concerning the 2007, will be published on the Ministry site.

Therefore confirm all the information over the past months.
The decree appeals to this critical moment, pointing out the necessity of restraining the entries and giving priority to the family care sector.
The above priority however clashes with the division of the restricted quota which now mean “limited quota”, since they involve the countries of major provenance.
In fact, colf and caretakers coming from Moldavia, the Philippines or other countries written on the list, are supposed to deal with the limited places available, whereas as far as other nationalities are regarded (i.e. Ukraine) the places are around two thirds of the total.

Moreover as it is already known, the great majority of the applicants is already present on the national territory. Therefore is all about a masked form of regularization carried out among the presences, namely the applications submitted the previous year: thousands of people excluded from the previous decree waiting for gaining a residence permit. Nothing to do for those who entered illegally or have fallen into illegality after the 31st of May 2008.

The previous year the applications were about 740,000, but these numbers actually emphasize the great quantity of invisible presences. This year on the other hand, as much presences might have been gathered. An army of illegal people, in the middle of the crisis, is risking to be at the mercy of exploiters and busybodies.
