Ius Migrandi vs Mos Maiorum – Europe beyond Europe is yet to be constructed

Mos Maiorum, a strange name for a European police action which opens the hunting season to those who “illegally cross borders”. And yet this is what they have called the joint operation which will see 18,000 police officers from all EU states working on migrants’ routes, from 13th to 26th October, under the coordination of the Italian Ministry of the Interior with the cooperation of Frontex. Perhaps it’s not such a strange name.

What is Mos Maiorum? It could be translated as “ancestral custom”, that is the mores and ethics which were the foundation of the patriarchal, Classic Roman civilization, that same morality which legitimated the conquests and expansion of the Roman Empire as the endeavor of “civilizing” the world. Mos Maiorum is thus a reference to the fundamental core of customs and traditions. A reference which is intended to warn, which aims to preserve, which immediately proclaims the superiority of those who employ it over those who remain outside the borders of the Empire.

This is by no means the first operation of the kind. With a certain regularity Europe has implemented attempts to sound out the territory in order to manage, check, investigate and prevent the movements of those who challenge its borders. And considering the results, we cannot but say there is little to be proud of. In the name of the struggle against traffickers, an exceptional deployment of intelligence and patrolling of the borders punctually ends with surprisingly dramatic results. Whilst people relentlessly flee war zones, or simply look for new life projects by moving, exercising their freedom of movement, thanks to operations like this, the European police design and re-launch their strategies.

It was the same with the previous operation Perkunas which revealed the propensity of undocumented “subjects” who run into police checks to present requests for international protection. Perkunas thus concluded its report, hypothesizing that there is an “abuse” of the assurances that asylum procedures offer. Yet nobody says in that document that by its very nature, a request for asylum is presented at the moment of entry, as is obvious, when lacking a visa, and that in any case it can be presented at any time. Nobody says that those who violate the borders and are called “clandestine”, when necessary, are the same women and men who die in the sea, who abandon the reception centres in the city of Milan, that they are the migrants who arrive at the Adriatic ports, those rejected by the commissions or who have lost their jobs. The same ones people we find in the exploitation camps, those who are forced to pay for everything, those who are unjustly blocked at the EU’s internal borders. In the meantime the boats sink, the pockets of the traffickers get fatter and fatter and millions of people are forced to live in the shadow of the absence of rights.

But perhaps, if we look closely at the Europe which we know today, so incapable of facing what is happening at its geographic borders, bogged down as it is in the vortex of austerity, the financial dictatorships, the national egoisms and security paranoia, we shouldn’t be so surprised at that reference to Mos Maiorum which can be seen as an attempt to find its path again, a desperate search for a lost identity on which to anchor itself. In the end, how can we blame the European authorities. What we see before our eyes is the ambivalent Europe we have always seen which has trouble recognizing itself: both cage and potentiality, a space for rights and for their denial, able to mourn its dead and persecute those alive, capable of condemning Italy for the pushbacks, the lack of reception and the disinfestation at the Cpsa of Lampedusa but at the same time promoting Frontex Plus, imposing the Dublin Regulation, the CIEs (Identification and Deportation Centres), the violence at the border. The voraciously inclusive Europe which is at the same time mercilessly exclusive needs to invent its Mos Maiorum to survive.

We know nothing about the identity of the creative neologist who enjoys dusting the covers of his classical studies to baptize each of the various Italian and European migration policy campaigns (apropos, neo-fascist right-wing Europeans also like contrasting virtus romana to inferior “races”). What we do know for sure, however, is that the tears shed for the anniversary of the 3rd October seem to have dried very fast. The same hands that threw the flowers into the sea to commemorate the dead of Lampedusa are ready to arm themselves against those who are not swallowed by that sea. After all, while the 368 victims of 3rd October may be a moving memory, from that day in 2013 to now, another 4,000 people have lost their lives in the waters of the Mediterranean.

For those who survive, for those who escape from the many “new and old wars” at the gates of Europe (more and more “civilized”, more pervasive and widespread) there is, instead Mos Maiorum. Its targets are none other than the thousands of families, women, men, children, young people who move and animate the audiences who watch the film On the bride’s side. Syrians, Iraqis, Palestinians, escaping from the barbarities of places which immediately recall the responsibility of those same governments which will trench along the borders; or Somalis, Eritreans, women and men from all those countries that are still ruled by the bloodthirsty dictatorships, the legacy of the colonial states. And it is against them, or rather against all of those who did not lose their lives during the route that this Europe, with this police operation, resuscitates its Mores Maiorum.
And so if it has to be Latin, let’s play the game too, let’s remind the creative neologist that there are people who will not hesitate to oppose Mos Maiorum with “Ius gentium”, that right which is not granted to anyone but which is intrinsic to human reason, (naturalis ratio) and which is observed in equal measure by all, amongst all peoples: the right which all populations make use of. Starting from Ius migrandi itself, initially invoked to justify the colonial strategy, but with time recognised as the right of every individual to abandon their country, affirmed also (not only) in article 13 of the Universal Declaration of Human Rights. And if that of escaping is an unaccomplished right, and is not matched with a full right to be received, it is up to us to make it effective and translate it into freedom; freedom to stay, to move, to choose one’s future (as written in the Charter of Lampedusa).
This is  #iusmigrandi  which will be the centre of a shared practice from the 13th to 26th October, at the same time as Mos Maiorum, the common objective of another “maxi-campaign” which will cross every European border. In the last few days thousands of people, collectives, associations started a tam tam which crossed every corner of the “Old continent”. Just as many will be ready in the next few days to protect those people that the European police want to apprehend, check, study, by offering them support, assistance, information, thus rejecting that call to obedience Mos Maiorum wants to affirm. Emergency numbers (like those offered by Watch the Med) for those who cross the borders, leafleting (in hundreds of cities), a massive campaign on the net and in the streets, animated by those who every day actively construct reception, help desks, battles, projects, cultural initiatives, studies, protests and much more, are already another Europe which is taking shape, from North to South, from West to East and beyond.

From 13 to 26 October #iusmigrandi will become a shared practice. Another “maxi-campaign” which will cross every European border

There may not be flash and television troupes there to immortalize that infinity of moments. The celebration of Lampedusa, the polemic which preceded, crossed and followed it are already a simple, bitter memory.
We, together with many others, already have a Europe, beyond Europe, to build.

mari în Europa. Scopul acestor intervenţii este de a depista persoane
care locuiesc ilegal in Europa, fără a deţine actele necesare.

Особый контроль ожидается на вокзалах, в поездах, в аэропортах, на автомагистралях и в приграничных областях.

Durante dos semanas 18.000 policias se encargarán de perseguir
personas sin documentos migratorios.

Bộ đội biên phòng và cảnh sát đang tìm kiếm người nước ngoài không có giấy tờ! Ngày 16 ­ 2014/10/23 chúng ta nên mong đợi kiểm tra chặt chẽ hơn tại các nhà ga, sân bay và đường cao tốc.

Từ 13 đến 26.10.2014 trên toàn bộ lãnh thổ EU, cảnh sát sẽ tiến hành chiến dịch mang tên „mos maiorum”(Pháp luật tập quán). Trong hai tuần đó, khoảng 1800 cảnh sát sẽ phối hợp chặt chẽ với cơ quan FRONTEX để săn lùng những người không có quy định cư trú. Nhiệm vụ của họ là tìm kiếm các tuyến đường di cư và bắt giữ càng nhiều người càng tốt.
Xin các bạn cảnh báo tất cả mọi người không có giấy tờ ! Đặc biệt chú ý đến các đoàn xe lửa, sân bay, đường cao tốc và những vùng gần biên giới nội địa EU, nơi mà kiểm soát sẽ tăng lên.
