Rumania – What happens at borders when someone goes back home?

I would like you to answer to a question that I believe many met when they thought of regularising Rumanian house keepers through past flows decree.
I managed to regularise my house keeper: I must admit that she spent a night in front of the post office and this is how I could employ her. The problem now stands in the fact that the Rumanian government enforced a provision that implies the suspension of passport for 1 to 5 years in case of citizens that spent more than 90 days abroad without proper permits. The Rumanian lady that works for me cannot possibly leave Italy, she would not be allowed to come back and regularly work. This citizen would obtain a work permit if she could go back to Rumania. What can we do?

Answer – Rumanian government enforced a sort of pre-condition that may allow it to enter EU and that provides for that passports are annulled if Rumanian citizens spend more than 90 days abroad without proper permits.

This fact frightens many citizens that are in Italy. The ones that were authorised employment are afraid that their passports are to be taken if they go back to Rumania in order to have Italian consular post issue the authorisation to legally enter Italy.

What should those citizens do?
This situation should not officially exist because authorisation to enter Italy are issued to citizens that should be in their home country. Employers apply to flows decree and they apply to be allowed to employ workers that live in their country of origin. Employers also declare that these workers are not in Italy.
This is pure fiction and we are not telling anything new. We all know that the most of workers are in Italy when authorised to come here. We’ve heard, but this has not yet been confirmed, that protest made Rumanian authorities repealed the disposition.
