Abstract
L’elaborato ha lo scopo di rispondere alla seguente domanda di ricerca: il nuovo sistema italiano è in grado di proteggere i minori non accompagnati?
La tesi è suddivisa in quattro capitoli principali: il primo riguarda la metodologia, nel quale verranno descritti la domanda di ricerca e gli strumenti utilizzati.
Il secondo capitolo si concentrerà sul quadro legale, sia a livello internazionale sia europeo: per quanto riguarda il primo, verranno analizzati gli elementi più rilevanti della Convenzione sui Diritti del Fanciullo e la sua successiva adozione a livello italiano; per quanto riguarda l’aspetto europeo, la regolazione di Dublino III, specialmente in relazione alla situazione italiana verrà presa in considerazione.
Il terzo capitolo esaminerà esattamente la Legge Zampa. In particolar modo, le maggiori novità della legge Zampa e in quale modo hanno cambiato la condizione dei minori non accompagnati.
Infine, il quarto capitolo analizzerà come è stata attuata la legge Zampa dopo più di un anno dalla sua approvazione e, in relazione a questo, quali sono le sue maggiori lacune e possibili miglioramenti, attraverso l’uso delle interviste fatte dall’autore.
Abstract
The aim of the thesis is to answer to the following research question: Is the new Italian system able to protect unaccompanied minors?
The thesis is divided in four chapters. The first chapter regards the Methodology, in which the research question and the relevant tools used in this research are going to be explained.
The second chapter describes the legal framework, both international and European: namely, with respect to the former, the relevant elements of the Convention on the Rights of the Child and the Italian adoption are going to be analysed; as regards the latter, the Dublin III regulation is going to be examined in relation to the Italian situation.
The third chapter will be focused on the case study of the research, namely the Zampa Law. Specifically, the main novelties are going to be pointed out and to what extent they have changed UAMs’ condition in Italy.
The fourth chapter is going to investigate how the Zampa Law is implemented after more than one year from its approval and, in relation to this, which are its main shortcomings and possible improvements. Lastly, brief conclusions are going to be presented.
