To tell you the truth things could be less tragic. You were rightly told that since you were unemployed since September 2002 you hed the right to a temporary looking for a job six months residence papers, and this is valid also with Bossi-Fini law. In fact the person we are referring about immediately found a job atr the coarse and within the six allowed monhs.
This person is now treated as a student since he now holds a student visa. He is beng treated as a person who reached Italy on studyin basis. But this is untrue. The interested person had the right to keep previous permit and here lays police headquarters mistake. The right to a looking for a job remained even if this man was to start a training coarse.
Rules of enforcement of laws art.14 considers this particular situation, this is to say that subordinated work residence papers allows to other activities even without the conversion of the permit held.
In other words, police headquarters shouldn’t have turned the papers into a student visa, since folowinga training coarse is allowed also when holding a looking for a job visa. Police changd papers without the iant person assent. And this often happens.
The right workes ave to follow trainings is undisutable. This is an international principle.
O.I.L. (International Labour Organization) Convention 143/1975 was accepted by Italian state.
This person we are referring to had no problems. He was unemployed and he started a coarse in order to improvehi qualification.
His papers shouldn’t have been changed, in case he had what he actually asked for he wouldn’t have had problems at the employment moment.
When he referred to the emplyment office, he was rightly told that nothing could be done. He was confirmed that a student cannot change a study visa into a work one. Laws state this: in case quota are not available the turning while staying in Italy is not possible.
But this is not the person’s siuation.
There’s something more to be said. European fund training coarses are not a normal student activity (a person cannot enter Italy on basis of such coarses), they provide for an ecomical grant, this is a sort of a documentation in order to have work papers renewed.
In other words, following such coarses can be considered a sort of a job. It was a police headquarters mistake.
We suggest this person to prepare a written aplication explaining all circumstacies as reffered us and adding what answered. Police headquarters should admit that they made a mistake and they should retify the study visa into a work one.
